How are car accident verdicts and settlements calculated? 

The amount of a settlement can vary substantially from each county and even with each jury, depending on the jurisdiction in which the accident occurred, in combination with the facts of the case. Variables like hospital bills, automobile repair bills, and expert witnesses, such as doctors, are used to determine the cost of an accident and what in most cases insurance companies will pay. 


Determining Financial Compensation Following an Accident 

Depending on the type of accident, compensation varies. Damages can fall under two categories: economic damages and non-economic damages. Examples of economic damages include: 


Present Medical Costs: Any cost related to immediate needs of the injured including hospital visits, long or short term care, medical devices, and visits with medical professionals. 


Expected Medical Costs: Expected costs include those that are expected to occur in the future or consist long term 


Lost Wages or Income: Compensation for wages or income lost between the time of injury and the conclusion of the lawsuit. If the victim demonstrates that their ability to earn income has been impacted negatively by the accident, they may be able to gain compensation. The awarding party will settle on an amount the victim could have earned if the accident had not taken place. 


Non-economic damages will compensate the victim and/or their family for non-monetary, intangible losses, including: 


Physical Pain:  Compensation for any physical pain sustained from injuries received in the crash. The nature of the injury and the amount of pain and time the victim will suffer as a result of the injury are included as factors in the award. 

Mental Anguish: Compensation for emotional distress originating from a motor vehicle accident, including grief, fright, embarrassment, worry, or anxiety caused by the accident. 

Loss of Consortium: Compensation awarded to the spouse, parents, or minor children for loss of services, aid, society, and companionship of a loved one lost in an accident. 

In addition to economic and non-economic damages, there may be punitive damages, which serve to punish the defendant and discourage repeat incidents. These may be pertinent if the defendant’s actions were intentional, malicious, reckless, or fraudulent. 


Motorcycle Accidents  

The number of new motorcyclists on roads and highways in Florida increases each year. Unfortunately, new motorcyclists are more likely to be involved in motorcycle accidents due to their inexperience on the road. Navigating the aftermath of a motorcycle accident is complex. The results of a motorcycle accident can be horrific.  Florida insurance regulations and dishonest insurance carriers may complicate the process of recovering compensation for injured motorcyclists.
