If you are detained by ICE while your removal proceedings are still pending, you may wish to be released from detention to better prepare for your case. In this situation, you can request a bond hearing, where a judge will determine your eligibility for release and set a specific bond amount if you are determined eligible. This bond money is a guarantee that you will return to court at a later date. The government will return the bond to you if you attend court. If you do not attend, you will lose the bond money and possibly be returned to detention.

Mandatory detention, which is when a person cannot be released on bond, may apply to certain foreign nationals. These include those who did not lawfully enter the United States, who have engaged in activities endangering national security, or those classified as arriving aliens. Arriving aliens is a term usually referring to foreign nationals returning from travel to another country. Additional behavior that will result in mandatory detention may include committing drug crimes, violent crimes, and theft crimes, provided that you were released from custody related to the crime after October 10, 1998. In 2019, the United States Supreme Court decided that foreign nationals who have been released after serving a criminal sentence can still be subject to mandatory detention. If you disagree with subjection to mandatory detention, you can argue that it should not apply at a “Joseph hearing.”

Bond Hearing Process

The bond hearing process starts with a very informal meeting that happens during the Master Calendar Hearing. During this hearing, the immigration official will decide if you are to stay in detention. If not, you may be eligible for release. The judges in each case have significant power to determine your fate. National security and the safety of the American people is the major factor in determining what the case outcome will be.

In the bond hearing case, you may be able to show evidence to the judge that you do not pose a risk to the American people. If you can prove that you have a stable life including a steady job, home, or family members, your argument is stronger. If you submit documents such as a birth or marriage certificate, it can improve your case significantly.

You can also present evidence to demonstrate that you will not pose a flight risk. This may include a lease or title of a home, employment in the United States, having close relatives in the country, and having a strong argument that you are eligible for immigration relief. Documents that may bolster your argument include copies of a marriage certificate, birth certificates of your children, pay stubs from your employer, and letters from your employer and other members of the community. If your family members attend your hearing, it will show additional strength of your relationship with them. While they likely will not need to verbally testify, their presence can give the judge physical evidence of your ties to the United States.

The judge may ask follow-up questions about your family relationships, employment, or criminal history, including convictions and arrests. If you think your criminal history may stand in the way at a bond hearing, you can provide letters from family and community members and people explaining how you have improved your life since the crime. These letters, along with certificates of completion from rehabilitation programs, can help to show good moral character.

What Happens After the Bond Hearing

If the immigration judge determines that you are eligible to be released from detention, they will set a bond amount of at least $1,500. The bond amount may vary if the judge believes that you are a flight risk or a major threat to the safety of the public or national security. The government attorney and your attorney might argue to raise or lower your bond amount, but the judge has the final word on the decision.

Once the bond has been set, the judge will issue a written order and reschedule your next Master Calendar Hearing. You will have up to 30 days to pay the bond and subsequently be released from detention. If you cannot secure the bond money, you will remain in custody until your next hearing. If you post the bond, you will be released and permitted to return home. The government attorney will seek that the court location change to the immigration court closest to your home, where your removal proceedings will resume in a court for non-detained foreign nationals.
